# Lien waiver

**A lien waiver is a signed document in which you give up some or all of your lien rights, usually in exchange for a payment. Waivers can be conditional (effective once payment clears) or unconditional (effective when signed), and some states require specific forms.**

> **Not legal advice.** This is a general explanation for contractors across the U.S. Lien and payment rules differ by state and by contract, and they change. Before you act on a lien, waiver or payment clause, talk to a construction attorney in your state.

## Why it matters on a drywall job

- GCs often require a waiver with each pay app before they release payment.
- Signing the wrong type, or signing before the money clears, can cost you rights for money you haven't received.

For one state's rules, see the [Texas lien guide for subcontractors](https://tapeandfloat.com/guides/texas-lien-deadlines.html). It covers Texas only.
