# Mechanic's lien

**A mechanic's lien is a legal claim against a property, filed by someone who supplied labor or materials and wasn't paid. Every state has its own lien law, with its own notice steps and filing rules.**

> **Not legal advice.** This is a general explanation for contractors across the U.S. Lien and payment rules differ by state and by contract, and they change. Before you act on a lien, waiver or payment clause, talk to a construction attorney in your state.

## Why it matters on a drywall job

- Lien rights can be a subcontractor's strongest leverage when a payment stalls.
- Those rights usually depend on sending notices on time, so it helps to track them per job from the start.

For one state's rules, see the [Texas lien guide for subcontractors](https://tapeandfloat.com/guides/texas-lien-deadlines.html). It covers Texas only.
